Greetings: 

I received a communication from your agency that I am no-longer being considered for employment.   First and foremost then, I need to let you know whom I am.  My name is Reinaldo Olavarria Roddriguez, and, I am providing a copy of the specific positions, titles, and dates of application for those positions.  My applications are registered with your agency electronically. 

The following questions and topics are of interest to me, and I am asking that you answer these questions to help me understand your hiring practices and the reason for my not being hired and no longer considered for the positions in question:
  • Was I treated differently than a similarly situated person who is not in my protected class (persons with a disability, specifically wheelchair users)?
    • What are the statistics of the hiring practices for the positions I applied for?
    • What are the general statistics for the hiring practices of your agency?
    • Is there a pattern of preference based on race, color, ethnicity, or disability, etc?
  • Why does your agency have a history of showing bias toward persons in my protected class?
    • Is there a reason as to why the mobility impaired disabled person are not represented at employment locations?
    • Again, what is the hiring rate of persons with mobility impairments/disabilities?
    • Do your internal statistics reflect an egregious or extremely low rate of hiring people with disabilities/mobility impairments?
  • Why are there noticeably few employees of my protected class at your workplace?
    • I have visited many of your centers and locations and have yet to encounter a person with a mobility impairment working for your agency, and/or with a noticeable disability; why is that the case?
  • Are there statistics that show favoritism towards or bias against any group?
    • What trends may be shown by your hiring practices? 
    • Again, do you have statistics on the hiring practices and current employment composition of your agency employees?
  • Did your agency retain less qualified, non-protected employees in the same job?  Yes  / No
    • Who was hired (the race, gender, ethnicity)?
    • Was the person disabled?
    • What was the educational and work related experiences of that person?
    • Was the person previously known to your agency?
    • Did that person have another positon with the your agency prior to being considered for the position?
    • What factors caused me to no-longer be considered for the position (please provide extensive details on that decision and whom was involved and how the decision was made)?
